OMTS Old Man Music Content License & Release Agreement
1. Grant of License
By submitting music, audio, video, or other media ("Content") through the Old Man Music submission form, the submitting party (the "Artist," which includes bands, musicians, radio stations, and any other content submitter) grants OMTS (Old Men Talking Sh#t) a non-exclusive, royalty-free, worldwide license to use, reproduce, display, stream, distribute, and promote the Content on the OMTS website, mobile app, podcast, social media channels, and other OMTS platforms.
2. Ownership Retained
The Artist retains all ownership rights to their Content. This Agreement does not transfer copyright or ownership — it only grants OMTS permission to use the Content as described above.
3. Artist's Representation of Rights
The Artist represents and warrants that they own the rights to the submitted Content, or have obtained all necessary permissions, licenses, and clearances (including from co-writers, performers, labels, or other rights holders) to grant this license. This applies equally to radio stations submitting content they broadcast or produce.
4. No Obligation to Use
OMTS is under no obligation to feature, use, promote, or continue using any submitted Content, and may remove Content from any OMTS platform at any time, for any reason, at our sole discretion.
5. No Compensation Implied
Unless separately agreed to in writing, this license is granted at no cost, and the Artist is not entitled to payment, royalties, or other compensation for OMTS's use of the Content.
6. Release and Indemnification
The Artist agrees to release, indemnify, and hold harmless OMTS, its owners, hosts, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from OMTS's use of the Content, where such claims relate to the Artist's ownership, rights, or authorization to submit the Content.
7. Governing Law
This Agreement is governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
8. Acceptance
By checking the box below and submitting the Old Man Music form, the Artist confirms they have read, understood, and agree to this Agreement.
